Defense fails to link motor vehicle accidents to woman’s case

Every day can bring either unexpected surprises or tragedies. Sadly, one never knows when events such as motor vehicle accidents will occur that leave devastation behind them. For one Maryland man, an ordinary meeting with fellow Boy Scout leaders led to his death in a senseless car crash.

The accident occurred in 2017. The 73-year-old Boy Scout commissioner was meeting other leaders at a local restaurant when a vehicle came hurtling through the establishment’s wall. The man was critically injured in the crash and died a week later of his injuries. The woman driving the vehicle was charged with vehicular manslaughter.

The woman has been sentenced to one year for her role in causing the victim’s death. Her defense attorney argued that several makes and models of Toyota vehicles were under recall for defective floor mats and gas pedals. The attorney stated that the vehicle experienced an unexpected acceleration that led to his client losing control of the car as she rounded a curve in the road. The prosecution refuted that the woman’s car was affected by the recall and that she was speeding on her own when the accident occurred.

The defense announced that it would appeal the sentence. Motor vehicle accidents cause not just untold physical and emotional pain, but they often lead to significant monetary damages. Families not only suffer the loss of their loved ones, but they are often burdened with medical bills and funeral expenses, and struggle with the loss of income. If a Maryland accident can be attributed to the negligence of another party, then there may be a basis for seeking legal recourse for those damages through a wrongful death civil lawsuit.
