Securing compensation when the at-fault driver is uninsured

On Behalf of | Jun 21, 2023 | Motor Vehicle Accidents |

When involved in a car accident, those involved naturally look towards the at-fault driver’s insurance company for compensation for damages. But what happens if the person who caused the accident does not have insurance?

This scenario, though complex, is not hopeless. Various strategies can help those harmed in an accident recover their losses.

Uninsured motorist coverage

In many states, insurance companies offer uninsured motorist coverage. This form of coverage protects drivers in the event of an accident with an uninsured driver. It covers medical expenses, loss of income and other damages. If you carry this type of coverage, your own insurance company steps in to cover damages.

Collision coverage

Collision coverage is another option. This coverage pays for the repair or replacement of your vehicle after an accident, regardless of who is at fault. If you have collision coverage, your insurance company can repair your vehicle, even if the at-fault driver does not have insurance.

Health and disability insurance policies

You can also use your health insurance to cover medical bills resulting from the accident. If you have disability insurance, this can cover loss of income if the accident results in a disability that prevents you from working.

Out-of-pocket payment

If the at-fault driver does not have insurance but possesses sufficient assets, they might agree to pay for your damages out-of-pocket to avoid legal action.

You can also file a lawsuit against the uninsured driver. If the court determines that the other driver was at fault for the accident, they may order them to pay for your damages.

Claiming against your own policy

In some cases, you might have coverage under your own policy that will cover damages caused by an uninsured driver. For instance, some insurance policies include a provision for underinsured or uninsured motorists.

There are many ways to secure compensation if you are in an accident with an uninsured driver, but be sure to understand your insurance policy and consider all possible options before making a decision.
